Terms of Service

These terms are an agreement between you and Marju Studio, Inc. ("Marju", "we", "us"), 2550 NW 72nd Avenue, #311, Miami, FL 33122, which runs Marju Studio at marjustudio.com and the Marju studio (the "Service"). If you use the Service for a business, you agree to these terms for that business too, and you confirm you're allowed to. Please read them. If you don't agree, don't use the Service.

1. What Marju does

Marju uses artificial intelligence to turn your product photos into on-model pictures. You upload a photo, choose models and a scene, and we make new pictures. The Service is for businesses and people selling their own products.

Early access. Marju is new and still changing. Features may be added, changed or removed, and the Service may sometimes be interrupted while we improve it.

2. Your account

• Accounts are by invitation. You must be at least 18 years old to use Marju.
• Keep your sign-in private. You're responsible for what happens under your account.
• The information you give us (your name, your brand, your email) must be accurate.

3. Your photos and the people in them

By uploading a photo, or picking one from a store, you confirm that:

• You have the right to use it, including permission from the photographer and written permission from every person in it for their photo to be processed and changed by AI, including having their face, body or likeness replaced, for your product pictures.
• Everyone in it is 18 or older (see section 4).
• It is your own photo or your own store's photo, not someone else's.
• Using it with Marju doesn't break any law or anyone else's rights, including rights of privacy and publicity.

You keep ownership of your photos. You give us permission to store and process them only to run the Service for you: to read the garment, check the photo, make pictures, fix them, and show them back to you.

4. Adults only

Marju only makes pictures of adults. You are responsible for making sure that everyone in the photos you upload is 18 or older.

As an extra safeguard, our system also looks at each photo before it's used. If it thinks a photo clearly shows a child, the photo can't be used. If it isn't sure, or can't read the photo, the photo is held until a person at Marju reviews it, and you aren't charged while it waits. We may decline any photo at our discretion.

This check is a safeguard, not a guarantee. People's ages can't be judged reliably from a photo: some adults look much younger than they are, and some teenagers look older. The check can hold back a photo of an adult, and it can miss a photo of someone under 18. Marju is not responsible for these errors, in either direction, and the check does not replace your own responsibility under this section.

We report apparent child sexual abuse material to the National Center for Missing & Exploited Children, as the law requires, and close the account that uploaded it.

5. The pictures we make

• They're yours. As between you and us, you own the pictures Marju makes for you, and we give you any rights we have in them. You may use them for any lawful purpose, including your store, ads and social media.
• AI makes mistakes. A picture can change a garment's colour, fit, detail or shape, or get a body or hand wrong. Check every picture before you publish it. You're responsible for making sure the pictures you use represent your products accurately to your customers.
• They show AI-made people. The models in your pictures are generated by AI. Where the law or a platform requires you to say that an image or a model is AI-generated, that's your responsibility. Don't present a Marju model as a real, identifiable person.
• Pictures made by AI may not be protected by copyright in every country, and similar pictures may be made for other people.

6. What you can't do

• Upload photos of anyone under 18, or of anyone without their permission.
• Make sexual or explicit content, or nudity. Lingerie, shapewear and swimwear photographed the way a store would show them are fine.
• Use Marju to impersonate a real person, to put a real person's face or likeness on a picture without their consent, to mislead or deceive, or to harass anyone.
• Upload anything you don't have the rights to, including photos from another brand's store, or anything illegal.
• Copy, resell or reverse-engineer the Service, get around its limits or safeguards, or overload it.

We may remove content and suspend or close accounts that break these rules.

7. Plans, billing and cancelling

• Frames. A frame is one picture. A picture that doesn't come back is never charged: the frame goes back to your balance automatically. Frames have no cash value and can't be transferred.
• Fixes. Quick fixes and the free reshoot are included. A hand fix is a person correcting a picture for you; we aim to deliver it within one business day, and your plan includes a number of them.
• Monthly plans renew automatically. A monthly plan is billed at the start of each month at the price agreed when you joined, by invoice or through our payment provider, and renews every month until you cancel. We'll send a receipt or invoice for each charge.
• Yearly plans. A yearly plan is paid once a year, upfront, at the price agreed when you joined, and renews every year until you cancel. The whole year's frames and hand fixes are added when the payment is made. We'll email you before each yearly renewal. Cancelling stops the next yearly renewal; the year you've already paid for isn't refunded, and its frames stay usable for 12 months from that payment.
• Cancelling. You can cancel at any time by emailing billing@marjustudio.com or replying to your invoice. Cancelling stops the next renewal; you keep your plan until the end of the month you've paid for. Unused frames and hand fixes roll over from month to month, and expire 12 months after your most recent payment. We'll email you 30 days before any expire.
• Free trial. A new account may start with free trial frames. Trial frames expire 3 months after the account opens. If an account never starts a paid plan, we close it and delete its photos and pictures 6 months after it opened. We'll email you 14 days before either happens, and starting a plan stops both.
• Refunds. Payments, monthly or yearly, aren't refundable, except for failed frames as described above, or where the law requires.
• Price changes. We'll email you at least 30 days before a price change applies to your plan, and you can cancel before it takes effect.
• Pilot and founding rates. If you joined at a pilot or founding rate, you keep that rate for as long as your subscription stays active without a break, unless the offer you accepted says otherwise.

8. Models

• Marju's house models may be used in the pictures we make for you. You may not use them outside pictures made with Marju, or to suggest that a real person endorses your brand.
• Models you create with "Create a model" are made up by AI, not photographed, and are private to your account.

9. What we do with your content

• We don't sell your photos or pictures, we don't use them to train AI models, and we don't give anyone permission to.
• We don't show your photos or pictures publicly, such as on our website, without your written permission.
• To make and fix pictures, your photos are handled by the providers we use and, for hand fixes, by the freelance editors who work for us under confidentiality. Our Privacy Policy lists them and explains how long we keep things.
• If you send us feedback or ideas, we may use them to improve Marju, without owing you anything for them.

10. Ending your account

You can delete your photos, or your whole account, at any time from your Account page (deleting the account is for its owner). We may suspend or close an account that breaks these terms or puts the Service or other people at risk. Sections 3 to 6, 9, 11 and 12 continue after an account ends.

11. Disclaimers and limits

THE SERVICE AND EVERY PICTURE ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PICTURE WILL BE ACCURATE OR SUIT YOUR PURPOSE.

TO THE FULLEST EXTENT THE LAW ALLOWS, MARJU IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, SALES OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NOTHING.

You agree to defend, indemnify and hold harmless Marju Studio, Inc. and its people against claims, losses and costs (including reasonable legal fees) arising from the photos you upload or pick from a store, the pictures you publish, or your breaking these terms, including claims by people pictured in your photos about their likeness, privacy, publicity or biometric rights.

12. Everything else

• We may update these terms. If a change matters, we'll tell you in the studio or by email, and ask you to accept the new version before you continue. Earlier versions stay available.
• These terms are governed by the laws of the State of Florida, United States, and any dispute will be handled in the state or federal courts in Miami-Dade County, Florida.
• If you believe something on Marju infringes your copyright or uses your likeness without consent, write to hello@marjustudio.com and we'll look into it promptly.
• If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver of it.
